A 72-year-old businessman, Pa Tunde Ponnle, has sued the Christ Embassy at an Ikeja Magistrate’s Court in Ogba, Lagos, for allegedly refusing to give up possession of his property at Egbeda.

The septuagenarian, suing through his company Miccom Cables and Wires Limited, said he is entitled to possess the warehouse at 21, Odebunmi Street, Miccom Bus stop, Egbeda.

He is praying the court to order Christ Embassy to vacate the warehouse.
Ponnle said the church rented it for N2.6million yearly, but when he wanted to use it, the church refused to quit the building.

The claimant said it issued the church with an April 30, 2016 quit notice, as well as a notice in writing last December 13 of his intention to recover possession of the premises.

“Notwithstanding the said notices, the defendant refused and or neglected to deliver up possession of the said premises and still detains same,” the claimant said.

He also asked for a mesne profit at the rate of N216,666.67 only per month from last October 1 until possession is given up.

Mesne profits are sums of money paid for the occupation of land to a person with right of immediate occupation, where no permission has been given for that occupation.

The claimant said he wanted to take possession of the property for personal use and to effect “substantial repairs” to it.
