The Office of the Attorney-General of the Federation and Minister of Justice has clarified that no inmate approved for clemency under the recent exercise of the President’s power of prerogative of mercy has been released from custody, as the process is still undergoing its final administrative review.
In a statement issued on Thursday, October 16, 2025, the Attorney-General of the Federation and Minister of Justice, Prince Lateef Fagbemi (SAN), explained that the review stage is a standard legal and procedural requirement before any release order is executed.
According to him, the current phase involves verifying that all names and recommendations endorsed by the Council of State fully comply with established legal and administrative criteria. Only after this verification is completed will the formal instruments of release be issued to the Controller-General of Corrections for implementation.
“It is important to note that the last stage of the exercise, after approval by the Council of State, is the issuance of the instrument for the implementation of the decision concerning each beneficiary. This stage affords an opportunity for a final look at the list for remedial purposes, if any, before the instrument is forwarded for necessary action,” the statement read in part.
Fagbemi emphasized that the review is not a delay but part of due diligence to ensure that only those duly qualified benefit from the President’s mercy. He added that the government remains committed to transparency and the rule of law in executing the prerogative of mercy.
“The rule of law does not rush; it ensures fairness,” the Minister said, assuring Nigerians that the public will be duly informed once all procedural checks are completed.
He further commended public vigilance and feedback on the process, noting that such engagement reflects citizens’ deep concern for justice and good governance.
The clarification comes amid public speculation following reports of approved clemency for certain inmates. The Ministry of Justice’s position underscores that while presidential approval has been granted, the actual release of beneficiaries awaits the completion of all statutory reviews and documentation.
