Sigh Of Relieve For House Of Reps Member As Appeal Court Upholds Election
It is a great sigh of relieve for Federal House of Representatives Member, Akolade Akinjo.
The appeal court has upheld his election contrary to the ruling of the tribunal
According to a report sourced by societynowng.com
THE Court of Appeal sitting in Akure, Ondo State, yesterday reversed the decision of the Election Petitions Tribunal, which nullified the election of a member of the House of Representatives, Mr. Kolade Akinjo, who is representing Ilaje/Ese Odo federal constituency in Ondo State.
The appellate court, led by Justice Abiriyu Shehu, upheld Akinjo’s election and faulted the tribunal’s decision that he was not eligible to contest the March 28 polls.
The tribunal had ruled that the lawmaker was not a member of the Peoples Democratic Party, PDP, at the time of the election because his membership card was not signed by the chairman and secretary in his ward.
The Appeal Court submitted that Akinjo’s challenger, Lucky Aiyedatiwa, of the All Progressives Congress, APC, would have had a good case if he had presented another card to show that Akinjo’s card was fake and not credible enough to attest to his membership of the PDP before the March 28 National Assembly election.
Justice Shehu however did not award any cost against the respondents.
Meanwhile, counsel to the APC, Titiloye Charles said his party had accepted the verdict in good faith and would soon make its position known
